A presente comunicação tem como propósito analisar o modo de participação do povo nas disputas políticas em torno das magistraturas por ele conquistadas, a partir da análise Maquiavel do paradigma republicano romano na obra Discorsi.

This research investigates 3- and 5-year-olds' relative fairness in distributing small collections of even or odd numbers of more or less desirable candies, either with an adult experimenter or between two dolls. The authors compare more than 200 children from around the world, growing up in seven highly contrasted cultural and economic contexts, from rich and poor urban areas, to small-scale traditional and rural communities. Across cultures, young children tend to optimize their own gain, not showing many signs of self-sacrifice (...) or generosity. Already by 3 years of age, self-optimizing in distributive justice is based on perspective taking and rudiments of mind reading. By 5 years, overall, children tend to show more fairness in sharing. What varies across cultures is the magnitude of young children's self-interest. More fairness (less self-interest) in distributive justice is evident by children growing up in small-scale urban and traditional societies thought to promote more collective values. (shrink)

To what extent do early intuitions about ownership depend on cultural and socio-economic circumstances? We investigated the question by testing reasoning about third party ownership conflicts in various groups of three- and five-year-old children (N = 176), growing up in seven highly contrasted social, economic, and cultural circumstances (urban rich, poor, very poor, rural poor, and traditional) spanning three continents. Each child was presented with a series of scripts involving two identical dolls fighting over an object of possession. The child (...) had to decide who of the two dolls should own the object. Each script enacted various potential reasons for attributing ownership: creation, familiarity, first contact, equity, plus a control/neutral condition with no suggested reasons. Results show that across cultures, children are significantly more consistent and decisive in attributing ownership when one of the protagonists created the object. Development between three and five years is more or less pronounced depending on culture. The propensity to split the object in equal halves whenever possible was generally higher at certain locations (i.e., China) and quasi-inexistent in others (i.e., Vanuatu and street children of Recife). Overall, creation reasons appear to be more primordial and stable across cultures than familiarity, relative wealth or first contact. This trend does not correlate with the passing of false belief theory of mind. (shrink)

Resumen: Durante la comisión de un crimen, testigos o víctimas, expuestos al habla del agresor pueden ser llamados, en forma posterior, a reconocer la voz de quien se sospecha es el autor del delito, con el fin de establecer si ellos la reconocerían como la voz del delincuente. Un ejemplo de esta situación, donde se vio involucrado el testimonio de testigos auditivos, fue durante el proceso del caso de Emilio Berkhoff, el joven universitario que fue declarado culpable de los delitos (...) de porte ilegal de armas y municiones y condenado a cinco años y un día de cárcel. El caso no estuvo exento de cierta controversia debido a las declaraciones públicas del imputado sobre supuestas violaciones al debido proceso. En este trabajo se revisa el procedimiento ocupado para la recolección de la evidencia auditiva a la luz de los criterios más ampliamente compartidos sobre la materia.: During the commission of a crime, witnesses or victims, exposed to the speech of the aggressor can be called, later, to recognize the voice of the person suspected of being the perpetrator of the crime, in order to establish whether they would recognize it as the voice of the offender. An example of this situation, where the testimony of hearing witnesses was involved, was during the case of Emilio Berkhoff, the young university student who was found guilty of the crimes of illegal bearing of arms and ammunition and sentenced to five years and one day in jail. The case was not exempt from some controversy due to the public statements of the accused about alleged violations of due process. In this paper we review the procedure used to collect the auditory evidence in light of the most widely shared criteria on the subject. (shrink)

A Proposta de uma Cartografia dos Descostumes envolve o mapear de deslocamentos de pensamento atinentes ao itinerário ético da educação em processo de violência e conflito direto com o cis-tema, uma vez que aborda as potências _queer_ atravessadas por forças e devires, processos e movimentos, encontrados nas fendas da realidade. A palavra “diálogo” importa na união do prefixo grego “dia” que significa “através”, num sentido de ponte, travessia. O sufixo grego “logos” é etimologicamente significado como palavra ou relação. O transdialogismo (...) reclama para si uma potência que fricciona o repertório de representações de verdades impostas e as experiências sensíveis que produzem efeitos em nosso corpo ultrapasassando os domínios e configurações do cis-tema e propõe uma nova geopolítica de gênero e sexualidade, sem identidades e padrões. A partir de tal pista, dois movimentos se mostram essenciais: 1) mapear as dissocializações e o controle dos corpos nas construções discursivas e normativas da maquinaria escolar; 2) Desedificar discursos educacionais que transitam no universo da representação (significado, significante e significação) na qual se baseia atualmente a pedagogia. Desdobra-se o acontecimento educação em processos, agenciamentos e dispositivos educacionais sem partirmos de objetivos pré-estabelecidos, mas considerando as pistas e movimentos das fendas sociais e encontrando potencias em realidades e cotidianos invisibilizados, mas, ainda assim, violentados e silenciados, partindo de um desejo do pesquisador de compreender esse _trans-corpus_ através de um olhar diverso, diferente, que redimensione o habitual. Por fim, o artigo cartográfico produziu um mapa cortado por linhas de intensidade que partiram do conceito de biopoder em direção ao de necropolítica como condicionantes da maquinaria escolar em seu entrelace junto ao cis-tema Capitalístico, mas que é afrontada pelo inabitual e pelo estranho que delineia as potências queer. I argue for a novel answer to the question “What is hope?”. On my view, rather than aiming for a compound account, i.e. analysing hope in terms of desire and belief, we should understand hope as an irreducible concept. After criticizing influential compound accounts of hope, I discuss Segal and Textor's alternative of describing hope as a primitive mental state. While Segal and Textor argue that available developments of the standard definition do not offer sufficient conditions for hope, I question (...) the deep‐seated idea that desire and belief are even necessary conditions for hope. My suggestion is that we should take seriously the fact that we hope in a great variety of ways and should question the search for elements that are common to all cases. A promising alternative follows the Wittgensteinian idea that cases of hope are related in terms of family resemblance, i.e. are multiply realizable on the ontological level while falling under the non‐definable concept of hope. In this article, I bring Marx and Adorno into conversation with affect theory to establish three points: First, an affective reading of the concepts of alienation and exploitation via Marx’s metaphor of the “vampire capital” explains how capitalism depletes raced, gendered, and sexed working class of their bodily and mental powers. Second, discussing these thinkers’ ideas in the context of the larger mind and body opposition revives attention to the body in contemporary political theory and exposes how the mind and (...) body opposition covers the suffering caused by capitalism. Third, it shows that we must theorize the mind and body, feeling and thinking, as a mediated relation to grasping how particularly negative feelings can generate critical thinking, necessary to rebel against the vampire capital. Social death, central to the evil of genocide, distinguishes genocide from other mass murders. Loss of social vitality is loss of identity and thereby of meaning for one's existence. Seeing social death at the center of genocide takes our focus off body counts and loss of individual talents, directing us instead to mourn losses of relationships that create community and give meaning to the development of talents.

In my paper, I present two competing perspectives on the foundational problem (as opposed to the descriptive problem) of quantifier domain restriction: the objective perspective on context (OPC) and the intentional perspective on context (IPC). According to OPC, the relevant domain for a quantified sentence is determined by objective facts of the context of utterance. In contrast, according to IPC, we must consider certain features of the speaker’s intention in order to determine the proposition expressed. My goal is to offer (...) a plausible and fair reconstruction of IPC. Drawing a parallel between quantifier domain restriction and standard cases of context dependence as indexicality, I argue that the speaker’s intentions can play a semantic role only if they satisfy an Availability Constraint: an intention must be made available or communicated to the addressee, and for that purpose the speaker can exploit any feature of the objective context (words, gestures, relevance or uniqueness of either the quantificational domain or of the referent in the context of utterance). An intention satisfying the Availability Constraint must be something that a hearer in normal circumstances is able to work out by relying on the physical surroundings of the utterance situation, on utterances exchanged during the previous conversation, and on background knowledge shared by speaker and addressee. Esto, según pretendo mostrar, puede vincularse de manera legítima con la polémica anticirenaica de Platón contra Aristipo. Para ello, por un lado, exploraré los rasgos del biotipo tiránico y su régimen concomitante en la República VIII-IX y, por otro, analizaré sus vínculos con los planteamientos anticirenaicos en el Gorgias. Este examen (...) permitirá ofrecer claves de análisis para dos pasajes muy discutidos de la República IX: el símil del ascensor y el número del tirano, que cobran una nueva luz a partir de la consideración de esta polémica intrasocrática.Plato put forward in Republic a cultural program which implies the redefinition of the role of traditional poetry due to its association with the democratic and tyrannical regimes. I intend to show that this point is connected with the anti-cyrenaic arguments that Plato raises against Aristippus. On the one hand, I will study the features of the tyrannical biotype and its correspondent regime in Republic VIII-IX, and, on the other, I will analyze its links with the anti-cyrenaic arguments in Gorgias. This exam will allow us to offer some clues to better understand two widely debated passages in Republic IX: the analogy of the lift and the tyrant’s number. Both acquire a new perspective when this intra-socratic polemic is taken into account. (shrink)

This essay examines the concepts of ‘professionalism’ and ‘ethics’ as they are used in health professions education and, in particular, medical education. It proposes that, in order to make sense of the construct of ‘professional ethics,’ it would be helpful to conceive of professionalism and ethics as overlapping but not identical spheres. By allowing for areas of professionalism that are not directly pertinent to ethics, and areas of ethics that are not directly pertinent to the professional sphere, ‘professional ethics’ as (...) a focus of medical education can come into sharper relief. The essay argues that professional ethics should be understood not only in relation to major ethical issues such as end-of-life decisions, but also in relation to everyday actions and decisions. The essay ends by raising questions about how and by whom professional ethics is best taught. (shrink)

Although the exclusion of LGBTs from the rites and rights of marriage is arbitrary and unjust, the legal institution of marriage is itself so riddled with injustice that it would be better to create alternative forms of durable intimate partnership that do not invoke the power of the state. Card's essay develops a case for this position, taking up an injustice sufficiently serious to constitute an evil: the sheltering of domestic violence.

The aim of this paper is to suggest that a necessary condition of autonomy has not been sufficiently recognized in the literature: the capacity to critically reflect on one’s practical attitudes (desires, preferences, values, etc.) in the light of new experiences . It will be argued that most prominent accounts of autonomy—ahistorical as well as history-sensitive—have either altogether failed to recognize this condition or at least failed to give an explicit account of it.

This article discusses whether it is rational and valuable to have hope in the face of the climate crisis. The aim is to explore a distinctive Kantian perspective characterized by three main elements. First, hope is not seen primarily as a means of sustaining action, but action is viewed as a condition for rational hope. Second, the value of certain ‘fundamental’ hopes is not merely instrumental but derives from their constitutive role in our practical identity. Here, I focus on Kantian (...) hope in the compatibility of our fundamental ends, happiness and morality. Third, the rationality of such a hope presupposes trust – in particular, trust that our conceptions of morality and the good life are sufficiently flexible to adapt to drastically new circumstances. The testimonies of Stilpo of Megara show an anti-Platonic position within the megaric program against fundationists attempts. This paper studies a particular point of this deployment. We will review the origin of the views that locate thruth on the onomastic or on the predicative level. This initial survey will provide the basis for the study of the paradoxes of the nomination, an element Stilpo used as a tool to challenge the theory of Forms, and the analysis of the aporias of (...) predication, through which he rejects the combination of parts of the sentence in order to represent reality. The figure of Stilpo reveals the dialogical context in which ancient philosophies developed and, at the same time, displays ways of thinking the relationship between language and reality often forgotten. Legal apparatus looks like a set of norms which rely on a rational project of life, yet it is possible, following Deleuze but also Hume and Kafka, to recognise the irrational aspect of this system. Is the law a dream? In what relation is the law with the subject? If the legal subject acts in a dream, what are the results? This paper develops around such questions with the aim of critically reflecting on the foundations of subjectivity and its connections (...) with the legal normativity that requires obedience as the main form of respect and adherence. In this apparently free and creative present, which is unfolded on a digital codex of information, it seems relevant to be highly suspicious of the barriers that are going to be tightened more and more around thought and its potential creative evolutions. Can we think of – beyond the legal/illegal, obedient/disobedient dichotomy – a system of social relations that, instead of giving space to the permanent and repetitive features of subjects, discovers a wider margin of affective, innovative and creative connections in response to the behavioral exemplifications of diktats? Im alltagssprachlichen Gebrauch beziehen wir den Begriff der Gerechtigkeit sowohl auf Verteilungen von Gütern als auch auf die Verfahren, durch die eine entsprechende Verteilung zustande gekommen ist. Rawls’ Konzeption von Gerechtigkeit als Fairness (Rawls 1999) bezieht sich auf die Verteilung von Gütern und Rechten und ist somit eine Konzeption substantieller Gerechtigkeit. Zugleich ist die Begründung seiner Gerechtigkeitsprinzipien prozedural: durch die Konstruktion des Urzustandes, in dem Parteien hinter dem Schleier des Nichtwissens Prinzipien auswählen, wird die Auswahl ebendieser Prinzipien determiniert.

The social world is saturated with powerful formations of knowledge that colonise individual and institutional identities. Some knowledge emerges as legitimised and authoritative; other knowledge is resisted or repressed. Psychosocial approaches highlight the unstable basis of knowledge, learning and research; of knowing and not knowing. How do we come to formulate knowledge in the ways that we do? Are there other possible ways of knowing that are too difficult or unsettling for us to begin to explore? Do we need the (...) authority of legitimised institutions and regularized methods to build secure knowledge? What might it mean to build _in_secure edifices of knowledge? How might we trouble notions of knowledge in processes of teaching, learning and research? This collection addresses these questions, drawing on a range of psychoanalytic and social theory, from Bion, Freud and Lacan, to Derrida, Kristeva and Zizek. Showcasing work from North America, Europe and Japan, contributors explore writing as a practice that can stabilise _or_ unsettle subjectivities; the unconscious relations between school practices, subjectivities, educational spaces and ideologies; implications of the productive energies and the deadening inwardness associated with mourning and melancholia for formal and informal learning; and the authority we invest in apparently rigid or ephemeral institutional spaces. Strongly empirical as well as theoretical in approach, this collection will be of interest to students and academics seeking ways to resist normative orders of legitimacy and coherence in education and research. This paper relates Arendt's critique of a labor society to her thoughts on the "good life." I begin with the claim that in the post-mass production era, Western societies, traditionally centered around gainful employment, encounter a decrease in the relevance of labor and can thus no longer rely on it as a resource for individual or social meaning. From Arendt's perspective, however, the current situation allows for the possibility of a transition from a society based on labor to a society (...) centered around activities. Plantea que la alta participación de mujeres en la migración mundial está relacionada con la demanda en empleos precarios, principalmente en servicios, y que el destino migratorio está relacionado con el género del migrante, lo que contribuye a explicar la feminización de los flujos sur-sur. Homeric criticism in Antisthenes and Erotics studies in Aeschines offer an interesting context to measure Platonic works and to study the importance and scope of the theories about the poetic character and epistemic power of language in the context in which Philosophy was formed as an autonomous genre.
